Submission Agreement and Release

This Submission Agreement and Release (“Agreement”) governs your submission of written responses, photographs, recordings, and other materials (collectively, “Materials”) to the dadda? project operated by ROH & ROSE INC. dba ROHOVA STUDIOS (“Rohova Studios,” “we,” “us”) and its organizers, curators, and authorized project collaborators (collectively, the “Project Team”).

By submitting Materials through the dadda? submission form, you confirm that you have read this Agreement, the Privacy Policy, and the acknowledgements presented during the submission process, and that you agree to be bound by them.

Eligibility and authority

You must be at least 18 years old to submit Materials. You represent that you created, own, or have the legal right and authority to submit the Materials you provide, and that you have obtained any permissions legally required from identifiable people appearing in or discussed in your submission.

You may submit only photographs and materials that you created, own, or have permission to submit. Your participation is voluntary. You will not receive payment or royalties for your submission or for future authorized uses of selected Materials unless separately agreed in writing.

Grant of rights

You grant the Project Team a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, edit, adapt, publish, display, distribute, and archive selected Materials in any media now known or later developed, including but not limited to gallery exhibitions, websites, social media, print, film, television, books, educational materials, press, documentaries, archives, and future versions of the project.

Selected submissions may be included in the exhibition, website, social media, publications, films, press, archives, and future presentations of dadda?. Submission does not guarantee selection or publication.

Editing, privacy, and supporting materials

The Project Team may edit, excerpt, anonymize, or otherwise modify Materials, including names and identifying details, to protect privacy and for editorial purposes.

To protect privacy, Rohova Studios will not intentionally publicly display the unobscured face or clearly identifying features of a child included in submitted materials unless any additional authorization Rohova Studios determines is necessary has first been obtained. Children and other individuals may be cropped, blurred, silhouetted, redacted, or otherwise obscured before public use. These measures reduce the risk of identification but cannot guarantee that someone will be impossible to identify from the surrounding image or context.

Sensitive personal information

Your submission may contain sensitive personal information, including information relating to physical or mental health, disability, race or ethnicity, religion, sexual orientation, gender identity, trauma, or family relationships. During the submission process, you separately consent to Rohova Studios collecting and privately reviewing such information that you voluntarily provide, and to publishing and sharing sensitive personal information contained in portions of your submission selected for dadda?, as described in this Agreement and the Privacy Policy.

You understand that information made public may be copied or redistributed by third parties outside Rohova Studios’ control.

Finality, retention, and requests

To the fullest extent permitted by applicable law, your submission is final and the permissions granted in this Agreement may not be revoked after submission. Rohova Studios is not obligated to return, delete, withdraw, or discontinue authorized use of submitted Materials except where required by applicable law.

Selected Materials and related permission records may be retained indefinitely as part of the dadda? and Rohova Studios artistic, documentary, editorial, promotional, legal, and historical archives.

Privacy or legal rights requests may be sent to [email protected].

Release

To the fullest extent permitted by law, you release and hold harmless the Project Team from any claims arising from the use of the Materials as described in this Agreement.
